Fabian vs. Desierto G.R. No. 129742, September 16, 1998 Facts: There was an administrative case file before the Office of the Ombudsman between Teresita Fabian, the petitioner, and Nestor Agustin, private respondent. The ombudsman ruled in favor of the petitioner and ordered the suspension of the respondent. Private respondent moved for a motion for reconsideration. The Ombudsman inhibited himself from hearing the case after finding out that the new counsel of the respondent was his “close associate”. The deputy tried the case and reversed the previous ruling. Fabian appealed to SC invoking Sec 27 of RA 6770 or the Ombudsman Act of 1989 which provides that “All administrative cases, orders, directives or decisions of the Office of the Ombudsman may be appealed to the Supreme Court by filing a petition for certiorari. . . Issue: Whether or not Sec 27 of the Ombudsman Act is valid. Held: No. SC Held that Sec 27 of the Ombudsman Act cannot validly authorize an appeal to SC from decisions of the Office of the Ombudsman because it violates the proscription in Sec 30 Art VI of the Constitution which provides that no law shall be passed increasing the appellate jurisdiction of the Supreme Court without its advice and concurrence.
